This Terms and Conditions shall govern the use of the Unilab Alagang Pinoy Card and the relationship between United Laboratories, Inc. (“Unilab”) and the member and his/her beneficiary.
The Member/Beneficiary agrees that by enrolling in the Unilab Alagang Pinoy (the “Alagang Pinoy”), availing its services, including the use of the Alagang Pinoy Website (“the Website”), he/she is bound by Alagang Pinoy’s Terms and Conditions and all future amendments thereto.
- The Unilab Alagang Pinoy is a prepaid health program specially designed to address the needs of the modern OFW family.
- Upon registration and payment of an initial Php6,000 fee, the OFW Member (“Member”) shall be able to shall be entitled to access medicines through an online and call center-based delivery system. Cost of the ordered medicines shall be deducted from the Php6,000 fee. This fee shall act as pre-paid credits wherein one (1) Philippine Peso is equivalent to one (1) credit.
- The delivery of medicines shall be free of change unless orders are below Php500 per order, or delivery areas are outside the Greater Metro Manila Area. Additional fees shall be deducted from the pre-paid credits in these instances.
- The Member shall also have the option to reload credits to their account in Php3,000 and Php6,000 increments.
- Member shall also receive communications through website updates, electronic mail notifications, call outs and SMS messages to update them on the news and events and other Alagang Pinoy and Unilab activities.
- Unilab expressly reserves the right to deny any application that it deems, in its discretion, necessary to comply with any applicable laws, government rules or requirements, requests of law enforcement or for its protection.
- Using the Website
- While using the website, the Member/Beneficiary will not:
- Violate any laws, third party rights, or our policies;
- Post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
- Distribute viruses or any other technologies that may harm Unilab, or the interests of users of the website;
- In the event of abuse of Website, Member/Beneficiary shall report the same to Unilab which may include offensive contents, and policy violations.
- Unilab reserves the right to suspend, or terminate the Program and member’s accounts, prohibit access to the website.
- Fees
Upon registration, member shall pay a fee of Php 6,000.00. This shall serve as credits which is valid until fully consumed through call center ordering of Unilab medicines. Should a member’s credit limit reach Php500, he/she shall receive a notice of a minimum balance. This notice shall be sent via e-mail to the member’s nominated e-mail address. This notice shall be e-mailed again to the member thirty (30) days after should no reloading of credits occur. Should a member wish for non-reloading and choose to terminate his account, this shall automatically result in termination of the membership.
The Member agrees to pay for the services in accordance with the Fees schedule as provided upon registration. Unilab reserves the right to change the fees upon notice to the Member.
Payments shall be made through the Swift Cash payment processing system by providing the details of a valid remittance payment (“Your Payment Method”).If for any reason Your Payment Method fails and Unilab is unable to receive payment, or if Unilab is charged a penalty for any fee it previously charged to Your account, Member agrees that Unilab Alagang Pinoy may pursue all available remedies in order to obtain payment for said fee. Member agrees that such remedies shall include, but not be limited to, immediate cancellation without notice to the
Member/Beneficiary of the membership to the UnilabAlagang Pinoy.
All fees and charges paid pursuant to this Agreement are non-refundable, except as otherwise provided herein.
- Term; modifications
This Terms and Conditions shall be effective upon registration. Member may cancel his/her registration with Unilab Alagang Pinoy within seven (7) days from the date of registration. In such event, the Member shall be entitled to a full refund of the registration fee. In case of cancellation beyond the 7-day period, the Member shall not be entitled to any refund.
Unilab reserves the right to modify this Terms and Conditions from time to time upon notice to the Member/Beneficiary. Unilab may also discontinue the Unilab Alagang Pinoy Program where circumstances warrant.
- Member Information
The Member shall, prior to registration, fill out and complete accurately a Membership Form for Unilab Alagang Pinoy. The Member agrees to regularly update the information submitted to Unilab Alagang Pinoy The Member shall hold Unilab free and harmless, and shall indemnify the latter, against any damage it may sustain due to inaccurate or false information provided by the Member. This shall be without prejudice to the right of Unilab to avail whatever remedy it may have under the law including but not limited to the cancellation of the membership to Unilab Alagang Pinoy.
The Member/Beneficiary understands and acknowledges that the information disclosed in the Membership Form and information obtained through the Unilab Alagang Pinoy are collected and stored in a (Unilab)-managed database. The said database shall be used and administered by Unilab to continue providing its services, and to monitor the use the Alagang Pinoy . The Member/Beneficiary likewise agrees that the information referred to in this Section may be disclosed to any Unilab-authorized third parties for any purpose that may include monitoring and following-up.
Any Member/Beneficiary’s information may not be used in any form of publication or promotional material without his/her prior written approval.
- Agents/Representatives; Receiving of Products
The Member agrees to be bound as principal by all the terms and conditions herein, including other terms, conditions and policies which exist now or in the future as may be published by Unilab Alagang Pinoy for any and all acts of any party who submits the correct access key(s) for the Member’s account and uses the Unilab Alagang Pinoy, unless unauthorized access to the Member’s account is due solely to the fault or gross negligence of Unilab.
Ordered Products shall be delivered to, and received personally by, the Member/Beneficiary. In the absence of the Member/Beneficiary, an authorized representative may receive the Ordered Products given they have the Alagang Pinoy Member Card and an authorization document from the registered Member/Beneficiary.
- Suspension/Termination; breach
Failure to comply with the terms and conditions of this Agreement and any Unilab Alagang Pinoy rule or policy shall be considered a material breach of this Terms and Conditions. Unilab shall provide the Member a notice of such breach either in writing or electronically (i.e., by email). In case of failure of the Member to remedy the same within ten (10) days from receipt of such notice, Unilab may terminate the membership and take any remedial action available to Unilab under the applicable laws. In such event, no fees will be refunded to the Member.
Unilab’s failure to immediately act upon or notify the Member of a breach, shall not constitute a waiver or relinquishment of the right to enforce the provisions of this Terms and Conditions in the future, and such right shall continue and remain in full force and effect.
- Unilab may, at its option, suspend the membership to Alagang Pinoy should the Member:
Violate any laws, third party rights, or our policies;
Post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
Distribute viruses or any other technologies that may harm Unilab, or the interests of users of the website;
- Limitation of liability
Unilab’s entire liability to the Member/Beneficiary, resulting from shall be limited to the fees paid by the Member.
Unilab shall not be liable to the Member/Beneficiary for any loss or damage incurred or suffered as a consequence of:
a Any malfunction, defect or error in any machine or system of authorization whether belonging to or operated by Unilab or its fulfillment partners.
b Any delay or inability of Unilab to perform any of its obligations according to these Terms and Conditions due to any mechanical, data processing, or telecommunication failure, act of God, civil disturbance, or any event outside Unilab’s control or as a consequence of any fraud or forgery;
c Any damage to or loss of or inability to retrieve any data or information that may be stored in the Unilab Alagang Pinoy Card or any device whatsoever.
d Failure of the Unilab fulfillment partners to perform and comply with its obligations in connection with the Unilab Alagang Pinoy and use of Unilab Alagang Pinoy Card;
e access delays or interruptions to website or service registration system;
f the loss of registration or processing of application;
g the failure for whatever reason to renew a registration;
h the unauthorized of the Member’s account with Unilab Alagang Pinoy, unless due solely to our fault or gross negligence;
i errors with regard to the processing of the Membership Form application; and
j any act or omission caused by the Member/Beneficiary or any third party in their behalf whether authorized or not.
The Member/Beneficiary acknowledges that Unilab Alagang Pinoy provides a venue to order medicines online or via call centers, as well as communicate with you via calls, SMS and e-mail on health and program-related topics.
- Indemnity
The Member/Beneficiary agrees to release, defend, indemnify and hold harmless Unilab and its agents, employees, officers, directors, shareholders and affiliates from and against any losses, damages or costs, including reasonable attorney's fees, resulting from any claim, action, proceeding suit or demand arising out of or related to Member/Beneficiary’s wrongful use of the Unilab Alagang Pinoy.
- Representation and warranties
The Member/Beneficiary warrants that all information provided to Unilab Alagang Pinoy as part of the registration process is true, current, complete, accurate, and reliable.
The Member/Beneficiary also warrants that the registration is done in good faith.
- Severability
You agree that the provisions of this Terms and Conditions are severable. If any part of this Terms and Conditions is determined to be unenforceable or invalid, the remaining terms and conditions of the Agreement will remain in full force and effect.
- Notices
All notices may be posted on the website and shall be deemed delivered within thirty (30) days after posting.
